Please take a moment to review these Terms of Service before accessing or using the IMHO application.

Understanding the Terms

Definitions

For clarity, the terms below have specific meanings when used in these Terms of Service. The definitions apply universally, whether they appear in singular or plural form.

The App refers to the software provided by IMHO, which you download and use on any electronic device.

App Store refers to the digital platforms operated by Apple Inc. (Apple App Store) and Google Inc. (Google Play Store), where the IMHO app is made available for download.

Affiliate means any organization or entity that is controlled by, controls, or is under common control with another entity. Control, in this context, refers to holding 50% or more of the shares, equity interests, or other voting securities.

Your Account refers to the personalized account you create to access and interact with our Services.

Country refers to the jurisdiction of California, United States.

Company (referred to as "the Company", "We", "Us", or "Our" in this Agreement) refers to Vapronix’s Apps, located at A-109, 1st Floor, Tower A, Ithum, A-40, Sector 62, Noida, Uttar Pradesh 201309.

Content means any materials such as text, images, videos, or other types of information that You post, upload, link to, or make available through the Service, regardless of format.

Device includes any electronic device that can connect to and access the IMHO app, such as a computer, smartphone, or tablet.

Feedback refers to any comments, suggestions, or ideas provided by You regarding the functionality, performance, or features of our Service.

In-App Purchase denotes any purchase made within the IMHO application, including products, services, items, or subscriptions, which are subject to both these Terms and the terms set by the relevant Application Store.

Service refers to the IMHO application, the platform provided for accessing our features and functionalities.

Terms and Conditions (also referred to as "Terms") constitute the entire agreement between You and the Company governing your use of the IMHO Service.

Third-Party Social Media Service refers to any external services or content (including data, products, or services) provided by third parties that may be incorporated, displayed, or made accessible within the Service.

You mean the individual using or accessing the Service or the entity or legal representative on behalf of whom the individual is using or accessing the Service, as applicable.

Acknowledgment

By using the IMHO Service, you acknowledge that you have read and agreed to these Terms and Conditions. This agreement governs your relationship with Vapronix’s Apps and outlines the rights and obligations of all users regarding the Service.

Your access to and use of the Service is contingent upon your acceptance and adherence to these Terms and Conditions. These Terms apply to everyone who accesses or uses the Service, including visitors, users, and others.

By continuing to use the Service, you agree to comply with these Terms. If you disagree with any part of these Terms, you must refrain from accessing or using the Service.

By using this app, you confirm that you are at least the minimum required age to access our services in your country. Users under the applicable age of digital consent must obtain parental consent to use the app.

Additionally, your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and disclose your personal information when you interact with IMHO. It also outlines your privacy rights and how applicable laws protect your information. We encourage you to read our Privacy Policy carefully before using the Service.

In-App Purchases

IMHO may offer in-app purchases for various products, services, or subscription plans. You can manage and customize your in-app purchase settings through your device’s settings or review the terms set by the application store from which you downloaded the app.

Once made, in-app purchases are non-refundable and are only accessible within the IMHO app. You cannot cancel a purchase once the download has begun, nor can you redeem in-app purchases for cash or transfer them to another user.

In the rare case that an in-app purchase fails to download or function correctly after installation, we will look into the issue as soon as it is brought to our attention. We will act swiftly and reasonably to either provide you with a replacement or issue a fix for the issue at no extra cost. 

If we are unable to resolve the issue within a reasonable period, or if it causes significant inconvenience, we will coordinate with the application store to process a refund for the relevant purchase amount. You can also directly contact the application store for assistance with refunds.

Please be aware that all billing and payment processing for in-app purchases are handled by the respective application store. These transactions are governed by the application store’s own terms and conditions. Any issues related to payments or transactions should be directed to the application store.

User Accounts

When you register for an account with IMHO, you agree to provide accurate, up-to-date, and complete information. Failure to do so could result in the immediate suspension or termination of your account.

You are responsible for safeguarding your account’s password and for any actions that take place under your account. This responsibility extends to any activity conducted on IMHO or connected third-party social media platforms.

You agree to keep your password confidential and to notify us promptly if you become aware of any security breach or unauthorized activity related to your account. Additionally, your username must not violate any legal rights, nor should it be offensive, obscene, or otherwise inappropriate. You cannot use a name that belongs to another person, entity, or trademark without proper authorization.

Content

Your Permission to Share Content

IMHO gives you the ability to upload and share content within the Service. You are responsible for ensuring that the content you share is legal, accurate, and appropriate.

By uploading content to IMHO, you grant us a non-exclusive, worldwide license to use, modify, display, perform, reproduce, and distribute that content across the Service. You retain full ownership of your content and remain responsible for safeguarding your rights to it. This license allows us to make your content available to other users of the Service, who can also use your content in line with these Terms.

You confirm and guarantee that: (i) the content you post is either owned by you or you have the necessary rights to share it and provide us with the licenses outlined in these Terms, and (ii) uploading your content on IMHO does not violate any privacy, publicity, copyright, contract, or other rights of third parties.

Content Restrictions

IMHO is not responsible for the content shared by its users. By using our Service, you acknowledge that you are solely accountable for the content you upload and for all activities conducted under your account, whether by you or someone else using your account.

You agree not to post any content that is illegal, offensive, harmful, intended to provoke disgust, threatening, defamatory, obscene, or otherwise objectionable. Some examples of prohibited content include, but are not limited to, the following:

Content that promotes or engages in unlawful activities.

Defamatory, discriminatory, or hateful content, including offensive commentary regarding religion, race, sexual orientation, gender, nationality, ethnicity, or any other specific group.

Spam, unsolicited advertisements, chain letters, or any other form of unauthorized solicitation, including lottery or gambling-related content.

Content that contains or may introduce harmful elements like viruses, malware, or any software designed to disrupt, damage, or limit the functionality of devices or networks.

Violations of intellectual property rights, including patents, trademarks, copyrights, trade secrets, and rights of publicity.

Impersonating others, including the company or its employees and representatives.

Violating the privacy of others. Posting false or misleading information.

IMHO reserves the right, at its sole discretion, to review and determine whether any content violates these terms and to remove or reject content accordingly. We may also modify, format, or edit content as we see fit.

We reserve the right to limit or suspend access to the Service if you share content that violates these guidelines. While we strive to maintain a safe environment, we cannot control all user-generated content on the platform. By using IMHO, you understand that you may be exposed to content that could be offensive, inappropriate, or incorrect, and you agree that IMHO will not be held responsible for any such content. We are not liable for any errors, omissions, or damages arising from your exposure to or interaction with content shared on the Service.

DMCA Notice and Procedure for Copyright Infringement Claims

If you believe that your copyrighted material has been infringed upon on our platform, you may file a notice in accordance with the Digital Millennium Copyright Act (DMCA). To do so, you must provide the following details in writing to our Copyright Agent (see 17 U.S.C 512(c)(3) for more specifics):

End User License Agreement (EULA)

By downloading, accessing, or using IMHO, you agree to be bound by the terms of this End User License Agreement ("Agreement"). You expressly acknowledge that any form of objectionable content, harassment, abusive behavior, or any content intended to harm or defame others is strictly prohibited. We maintain a zero-tolerance policy towards such actions. Violation of these terms may result in immediate suspension or termination of your account, without notice or refund. 

Below, we have explained all the terms of the EULA that help in providing a safe and secure experience to the users. It includes: License, Restrictions, Content Ownership, and Termination. 

Content Backups

While we perform regular backups of the content within our Service, we cannot guarantee that data will be fully protected from loss or corruption.

Backup failures may occur due to various factors, such as pre-existing corruption in the content or changes made to the content during the backup process.

IMHO will provide support and work to resolve any known or identified issues that might affect content backups. However, you acknowledge that we are not responsible for the integrity of your content or for any failure to restore it successfully. It is your responsibility to keep a separate, secure copy of all content outside the Service.

Copyright Policy

We honor the intellectual property rights of others and expect our users to do the same. Our policy is to address claims of copyright or other intellectual property infringements involving content posted through the Service.

If you are a copyright owner or are authorized to act on behalf of one and believe that your work has been copied in a way that infringes your copyright, please send us a written notice to our copyright agent at support@imho.cool. The notice should include a detailed description of the alleged infringement.

Please note that if you make a false claim of copyright infringement, you may be held liable for any damages, including legal costs and attorney fees, resulting from such misrepresentation.

Your Feedback

By providing feedback to us, you transfer all rights, titles, and interests in such feedback to the Company. If, for any reason, this transfer is not effective, you grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, modify, distribute, disclose, and exploit your feedback without any limitations.

Links to Other Websites

Our Service may include links to third-party websites or services that are not controlled by the Company. We do not manage or oversee these external platforms, and we assume no responsibility for their content, privacy policies, or practices.

You acknowledge and agree that the Company is not liable for any damage or loss caused by or in connection with the use of third-party content, goods, or services. We highly recommend that you review the terms of service and privacy policies of any third-party websites you visit.

Termination

We reserve the right to suspend or terminate your account at any time, without notice, for any reason, including but not limited to violations of these Terms and Conditions.

Once your account is terminated, you will no longer have access to the Service. If you wish to terminate your account, simply stop using the Service.

Limitation of Liability

Regardless of any damages you may incur, the Company’s total liability, and that of any of its suppliers, under these Terms, shall be strictly limited to the amount you paid through the Service, whichever is less if no purchase has been made through the Service.

To the fullest extent allowed by law, the Company and its suppliers will not be held liable for any special, incidental, indirect, or consequential damages arising from the use or inability to use the Service. This includes, but is not limited to, loss of profits, data, business interruption, personal injury, or privacy issues related to the use of the Service, third-party software, or third-party hardware. This applies even if the Company or its suppliers have been made aware of the possibility of such damages or if a remedy fails to meet its essential purpose.

Please note in certain jurisdictions, the exclusion of implied warranties or limitations on liability for incidental or consequential damages may not be enforceable. In such cases, each party's liability will be limited to the fullest extent permissible by local law.

Service Disclaimer and Limitation of Warranties

The Service is offered to you "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied. To the fullest extent allowed by law, the Company, along with its Affiliates, licensors, and service providers, disclaims all types of warranties related to the Service, including but not limited to implied warranties of merchantability, fitness for a particular purpose, ownership, non-infringement, and warranties arising from the course of dealings or trade practices.

The Company does not promise that the Service will meet your specific needs, function seamlessly with other software, or deliver desired outcomes. Furthermore, there are no guarantees that the Service will be uninterrupted and error-free or that any potential issues will be resolved. The Company makes no claims regarding the compatibility, performance, or reliability of the Service, and it does not guarantee that errors or defects will be fixed.

Additionally, neither the Company nor any of its providers offer any assurances about (i) the accessibility or functioning of the Service, or the quality, accuracy, or completeness of any content or products available within it; (ii) the uninterrupted, error-free operation of the Service; (iii) the reliability or timeliness of any information provided through the Service; or (iv) that the Service, servers, or emails from the Company are free of harmful components like viruses, malware, or other malicious elements.

In certain jurisdictions, exclusions and limitations on warranties or statutory consumer rights may not be allowed, meaning some or all of the disclaimers here may not apply to you. Where applicable, the exclusions and limitations outlined in this section will be enforced to the fullest extent permissible under local law.

Zero Tolerance for Objectionable Content

IMHO has a strict no-tolerance policy regarding objectionable content and abusive users. This includes but is not limited to:

Harassment, bullying, threats, or hate speech

Sexually explicit, violent, or discriminatory content

Attempts to exploit, impersonate, or harm other users

Encouraging self-harm or harm to others

Any user found violating these rules may be permanently banned from using IMHO, and we reserve the right to take appropriate legal action or notify relevant authorities where necessary.

Governing Law and Legal Compliance

The governing law of these Terms and your use of the Service will be determined by the laws of the Country, excluding any conflicts of law principles. Your use of the Application may also be subject to additional local, state, national, or international laws.

Dispute Resolution

If you have any concerns or disputes regarding the Service, you agree to first attempt to resolve the issue informally by contacting the Company.

For Users in the European Union (EU)

As an EU consumer, you are entitled to the mandatory provisions of the law applicable in the country of your residence.

U.S. Legal Compliance

You confirm that: (i) you are not located in a country subject to a U.S. government embargo or designated as a "terrorist-supporting" nation, and (ii) you are not listed on any U.S. government prohibited or restricted parties list.

Severability and Waiver

Severability

If any provision of these Terms is found to be unenforceable or invalid, the provision will be amended to reflect its original intent to the greatest extent possible under applicable law, and the remaining provisions will remain in effect.

Waiver

Except as explicitly stated, the failure to enforce a right or requirement under these Terms does not affect the ability to enforce such rights or obligations in the future. Waiving a breach does not waive any future violations.

Translation and Interpretation

These Terms and Conditions may have been translated for your convenience. In the event of a dispute, the original English version will prevail.

Modifications to These Terms and Conditions

We reserve the right to amend or replace these Terms at our discretion. Should any changes be substantial, we will attempt to notify you at least 30 days prior to the changes taking effect. What constitutes a material change is at our discretion. By continuing to access or use the Service after such revisions are made, you agree to be bound by the updated Terms. If you disagree with the new terms, please cease using the Service.
